General terms and conditions

1-The contract holder is responsible for the additional drivers authorised to drive the rented vehicle.

  -The insurance allows the rental to persons over 24 years of age, with 3 years of experience.

  -The rental days are calculated as follows:1 TO 2 DAYS = Business hours. From 3 DAYS = 24 hours, since the client has rented the vehicle.

  -Credit cards: VISA and Mastercard are accepted. Both franchises and their removal must always be paid with credit cards. In case the customer chooses the CDW option, payment by debit card is allowed.Assistance365 days a year.Fuel policyOn delivery of the vehicle, we check the fuel tank, and the customer has to return it. If the customer does not return the tank the same, we will charge 10 euros, in addition to the fuel difference, as refuelling costs.Traffic finesSOLYMAR Rent a car is obliged by law to provide the authorities with the details of customers who receive a traffic fine during the rental period.The customer will have to pay the fine directly to the authorities.

1.1 Should Rent a car SolyMar consider that any of the following obligations are being violated, SolyMar reserves the right to take legal action.

1.2 Check the vehicle before moving it from the parking space and inform Rent a car SolyMar of any discrepancies regarding the condition of the vehicle.
1.3 Rent a car SolyMar does not, under any circumstances, assume the installation of accessories on the rented vehicle.

1.4 Obligations of the contract holder and authorised drivers: To notify Rent a car SolyMar of any technical faults (fluid, oil, water levels), tyre pressure, etc. In case of accident, breakdown or mechanical failure, follow the procedure established by Rent a car SolyMar: Do not repair the vehicle without prior authorisation. Do not request roadside assistance. Do not leave the vehicle without the necessary measures, stay with the vehicle until the arrival of the service. To notify SolyMar within 24 hours of any damage caused to the vehicle. Rent a car SolyMar will assess the situation and study the most effective solution. In addition, only in the event of damage, the driver must fill in an accident report and hand it in to SolyMar.
The accident report must state the circumstances, place, date and time of the incident, possible witnesses and full contact details + telephone number of any third party involved, together with photos of the accident and documents of the other party. If the accident report is not duly completed or in the event of negligence on the part of the client, SolyMar reserves the right not to provide a replacement vehicle. Furthermore, the cover may be invalidated.
In case of theft or robbery of the rented vehicle, file a police report, if this document is not provided to SolyMar, the cover may be invalidated. Notify SolyMar of the theft or robbery of the rented vehicle within 24 hours. If the contract holder does not hand over the keys, he/she will be responsible for the payment to SolyMar of the value of the total excess of the vehicle (value of the car at the time). This clause shall only cease to apply if the police report shows that the keys of the vehicle have been stolen. Respect the rules of the Highway Code.
Respect the established speed limits. Any damage to the rented vehicle as a result of driving the vehicle in the wrong lane shall be considered negligence, the cover contracted shall be invalidated and the contract holder shall be liable. Any damage caused to the vehicle as a result of an error in shifting gears shall be considered negligence, the contracted cover shall be invalidated and the contract holder shall be liable.
SolyMar shall not be liable for the repair of the following faults or damage or for any compensation that may be due: negligence or inappropriate use by the drivers of the vehicles, not closing the bonnet properly and not complying with the instructions for use and maintenance by the manufacturer in the instruction manual, breakdowns caused by continuing to drive when the oil pressure, temperature or brake gauges indicate, the changing of tyres due to vandalism or negligence by the drivers, breakdowns caused by the absence of cleanliness in the vehicles when these are used in areas with mud, sludge or similar.

1.5 Picking up the vehicle at the airport:

-The minimum rental period at the airport is 3 days.

-The pick-up and drop-off service at the airport is free of charge. The client will pay the cost of the ticket from 18h, when the vehicle is picked up.  Rent a car SOL&MAR will pay the parking ticket when the client returns the vehicle at the end of the contract, within our business hours (8h to 20h), if the client returns the vehicle outside these hours, must pay the parking ticket, after 20h, (pay 31€), if you return the vehicle between 4am and 8am, you will have to pay €2.70 per hour, which is the price of the public car park.

2. Return the vehicle with its keys, accessories and extras in the same state of operation and cleanliness in which it is delivered. If the contract holder returns the vehicle in a different condition to that specified, the contract holder shall be liable for any alterations made.

2.1 SolyMar offers a courtesy margin of 60 minutes for the return of the vehicle. In the event of late return, the contracted cover will be invalidated. The hirer is also responsible for the payment of the daily rental rate. Check the vehicle before returning the keys and make sure that you have not forgotten any belongings. SolyMar will not be held responsible. If the Hirer requests the return of his belongings, he shall bear the costs.

2.2 Failure to comply with the obligations described will invalidate the contracted cover and/or the minimum excess:
1) Not driving the vehicle under the influence of alcohol, drugs or any other substance that may affect driving.

2)Driving the rented vehicle only by drivers authorised by SolyMar in the contract.

3) Supplying the vehicle with the correct fuel. The wrong fuel will be considered as a new damage.

4)Not to leave the vehicle without fuel and/or adblue or any other liquid necessary for the correct operation of the vehicle.

5) Do not drive on unpaved or unauthorised roads.

6) Do not travel in larger numbers.

7) Not to use the rented vehicle for illegal activities.

8) Not to participate in races or competitions with the rented vehicle.

9) Not to sublet the vehicle.

10) Not to use the vehicle for towing other vehicles.

11)Not to use the vehicle for the transport of animals.

12)Not to use the vehicle for the transport of explosives.

13)Do not use the vehicle for the transport of corrosive substances.

14) No smoking inside the vehicle. (In case the vehicle smells of tobacco, SolyMar will apply a penalty to cover the costs of special cleaning treatment.

15) Do not leave the lights on and do not run out of battery.

16) Provide SolyMar with an accident report.

17) Parking without the handbrake.

 

2.3 Our prices DO NOT include:

1)Additional mileage (vans).

2)Fuel.

3)Additional extras (child seats and gps).

4)Additional driver supplement (from a 3rd driver).

5)Charge for loss or misplacement of accessories, keys and documentation and for damage to accessories.

6)Fuel error charge.

7)Special cleaning charge.

8) Charge for smoking inside the vehicle.

9)Charge for driving outside the territory authorised by SolyMar (Only Palma de Mallora).

10)Charge for late return of the vehicle.

11)Charge for abandonment of the rented vehicle.

12)Charge for returning the rented vehicle in express parking.

 

2.4 No refund will be given for early refunds.

 

3- Basic coverage with excess: Basic coverage: The rental rates also include SOL&MAR BASIC COVERAGE, including damage to the vehicle as a result of:
1) collision2) theft3) and fire or accidental vandalism.

The Basic Cover includes an excess for these damages. This excess must be guaranteed by the corresponding deposit or by taking out Additional Coverage. Only drivers authorised by SolyMar in the contract are covered by the basic cover with excess. The cover is valid for the duration of the contract. In the event of late return of the vehicle, the cover becomes invalid. The basic coverage with excess includes the following benefits:The partial waiver of liability for collision damage or theft reduces the financial liability of the contract holder for damage to or theft of the rented vehicle. In the event of damage to the vehicle, the contract holder shall be liable to pay for the damage up to the limit of the excess of the rented vehicle, provided that the vehicle is used in accordance with the terms and conditions, otherwise the basic coverage with excess shall be invalidated and the contract holder shall be liable to pay the full excess (current value of the vehicle).

3.1- No excess cover: Only drivers authorised by SolyMar in the contract are covered by the No Excess cover. The cover is valid for the duration of the contract. Excess: Category A,B,B,D,E,F = 300€, Category G,GG,H = 500€, Category I,J = 900€.

3.2- The coverage without excess includes the following benefits:

1) If the contract holder follows the procedure established by SolyMar in case of accident, breakdown, mechanical failure, or theft, he/she will not be responsible for the payment of any amount that is covered by the contracted insurance.

2) In case of breakage, loss, theft, robbery or forgetting the keys inside the vehicle, SolyMar is not responsible for the cost of the assistance service. In the event that the client leaves the lights on and the battery runs out, SolyMar is not liable for the cost of the service.

3.3 Exceptions to cover: No Excess cover does NOT include:
1) The loss or damage was caused by a breach or violation of the obligations and conditions set out in this rental contract.

2)The loss or damage was caused by elevated or hanging objects, barriers and bumps placed at an incorrect height,

3) improper transportation of objects both inside and outside the vehicle,

4) natural disasters,

5) phenomena of a catastrophic nature,

6) armed or warlike conflicts, demonstrations, riots, popular movements, terrorist acts, acts of sabotage, strikes or restrictions on free movement,

7) those caused by a change in the atomic structure of matter, or its thermal, radioactive and other effects,

8) damage to tyres (including punctures), rims, etc.,

9) the windows (front and rear) of the vehicle. 

10) The loss of the vehicle′s documentation.

11)The loss of the vehicle registration plate.

12) Breakage, theft or forgetting the keys inside the vehicle SolyMar is not responsible for the cost of the service.

13) Damage to the underbody and roof.

14) Damage to the interior of the vehicle and cargo area.

15) Damage to clutch.

16) Damage to engine.

17) Special cleaning.

18) Wrong fuel. 19) Damage to optional extras (GPS, child seats, etc.)

20) Damage to additional equipment (tray, spare wheel, antenna, warning triangle, etc.)

21) Damage to upholstery.

22) Lights on and the battery runs out. A rental will check the vehicle on return. We will send you an evaluation with a detailed estimate of the costs.

4-Cancellation of the reservation: Cancellations without penalty must be made at least 24 hours before the start of the rental. 1 day′s rental will be charged at the rate in force at the time of cancellation.
